AXIOM Terms of Service

By using AXIOM you agree to these terms.

1. What AXIOM is

AXIOM is a personal intelligence engine in beta. It captures your thoughts, builds a private knowledge graph of your life, and proactively surfaces context. AXIOM is operated by James Gibbins as sole proprietor in Calgary, Alberta, Canada.

2. Eligibility

You must be at least 13 years old to use AXIOM. If you are under 18, you must have a parent or guardian's permission.

3. Beta service

AXIOM is currently in closed beta. Features may change, be added, or be removed without notice. The service may experience downtime, errors, or data inconsistencies. While we take reasonable care to protect your data, AXIOM is provided as-is during the beta period.

4. Acceptable use

You agree not to use AXIOM to violate any law or regulation; harass, abuse, or harm another person; send spam or unsolicited messages; attempt to gain unauthorized access to AXIOM's systems or other users' data; reverse-engineer AXIOM's intelligence layer; misrepresent your identity or impersonate another person; use AXIOM in any way that could harm minors; or make decisions with significant legal, financial, or medical consequences without independent professional verification.

5. Your content

You retain ownership of everything you tell AXIOM. By using AXIOM, you grant us a limited, non-exclusive license to store, process, and surface your content as needed to provide the AXIOM service to you. We do not claim any other rights to your content. We do not use your content to train AI models.

6. Third-party services

(a) Connected services. If you connect a third-party service to AXIOM (such as Google, Uber, or others), you authorize AXIOM to access data from that service and to perform actions through that service on your behalf, subject to the permissions you grant on that service's consent screen. You are responsible for reviewing and understanding the permissions you grant. You may revoke these permissions at any time.

(b) Action services. When you ask AXIOM to perform an action through a third-party service (such as ordering a ride), AXIOM acts as your agent and transmits your request to the third-party service. You are responsible for any costs, obligations, or consequences arising from actions performed by third-party services at your request through AXIOM. AXIOM is not a party to any transaction between you and a third-party service.

(c) Third-party terms. Your use of third-party services through AXIOM is also subject to those services' own terms of service and privacy policies. In the event of a conflict between these terms and a third-party service's terms, the third-party service's terms govern your relationship with that service.

7. Location services

AXIOM may request your location to fulfill location-dependent requests (such as finding nearby services or ordering a ride). Location sharing is always optional. You may decline any location request, and AXIOM will inform you if it cannot fulfill a request without your location. See our Privacy Policy for details on how location data is collected, stored, and retained.

8. No medical, legal, or financial advice

AXIOM is not a medical, legal, or financial professional. AXIOM may help you remember appointments, prescriptions, or financial deadlines, but you must verify critical information with qualified professionals before relying on it.

9. Limitation of liability

To the maximum extent permitted by applicable law, AXIOM and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of AXIOM, including but not limited to damages arising from errors or omissions in AXIOM's responses, actions performed by third-party services at your request through AXIOM, loss of data or service interruptions, or unauthorized access to your data caused by circumstances beyond our reasonable control.

AXIOM's total liability for any claim is limited to the amount you have paid for AXIOM in the twelve months preceding the claim, or fifty Canadian dollars (CAD $50), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless AXIOM and its operator from any claims, damages, or expenses arising from your use of AXIOM in violation of these terms or applicable law.

11. Intellectual property

AXIOM's software, algorithms, branding, and documentation are the intellectual property of James Gibbins. These terms do not grant you any rights to AXIOM's intellectual property beyond the limited right to use the service.

12. Termination

You may stop using AXIOM at any time. To delete your account and all associated data, email privacy@mythoughts.ca. We may suspend or terminate your access for violation of these terms. In cases of urgent abuse, we may act immediately; otherwise, we will provide reasonable notice.

13. Changes to these terms

We will notify users of material changes via SMS or email at least 30 days before they take effect. Continued use of AXIOM after changes take effect constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of AXIOM will be resolved in the courts of Calgary, Alberta.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire agreement

These terms, together with the AXIOM Privacy Policy, constitute the entire agreement between you and AXIOM regarding your use of the service.

AXIOM Privacy Policy

AXIOM is a personal intelligence engine operated by James Gibbins (sole proprietor, Calgary, Alberta, Canada). This policy describes what information AXIOM collects, how it is used, and the choices you have. AXIOM is currently in closed beta with a small invited user base.

1. Information we collect

(a) Information you provide directly

When you sign up, we collect your phone number and (optionally) your email address. When you use AXIOM via SMS, web, voice, or mobile, we collect the messages you send us and the metadata about when and how you sent them.

(b) Images and media

If you send AXIOM a photo or image via MMS or web upload, we store the image file, any metadata embedded in the file (such as camera model, dimensions, and GPS coordinates if present), and an AI-generated description of the image contents.

(c) Location data

AXIOM may collect your location in the following ways, each requiring your explicit action:

Location data is stored in your personal database. Precise location data older than 30 days is automatically reduced to approximate city-level accuracy. You may disable location logging at any time without affecting AXIOM's other functionality.

(d) Information from connected services

If you choose to connect a third-party service (such as Google or Uber), AXIOM will access data from that service only as needed to fulfill requests you make. The specific data accessed depends on the permissions you grant on that service's consent screen. For Google, AXIOM may read your calendar events, Gmail messages, Drive file metadata, and contacts, depending on which permissions you approve. For action services such as Uber, AXIOM may request rides or perform other actions on your behalf, only when you explicitly ask.

(e) Information generated by AXIOM

As AXIOM processes your messages, it builds a private knowledge graph of entities (people, places, events, items) you have mentioned. This graph is stored only in your personal database and is never shared with other users.

2. How we use information

We use the information AXIOM collects exclusively to provide AXIOM's service to you: to remember things you tell us, answer questions about your own life and history, send you reminders and briefings, fulfill action requests you make (such as ordering a ride or checking prices), and improve AXIOM's reliability through anonymized, aggregated error logs.

We do not sell your data. We do not share your data with advertisers. We do not use your data to serve advertisements of any kind. We do not use your data to train AI models, and our AI subprocessor (Anthropic) does not train its models on AXIOM data either. Anthropic retains API messages for up to 30 days for safety and abuse monitoring per their standard commercial API terms, after which messages are deleted. We do not aggregate your data with other users' data for any purpose other than anonymized operational metrics (such as total message counts and error rates).

3. Google API Services — Limited Use disclosure

AXIOM's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

4. Third-party action services

When you ask AXIOM to perform an action through a connected third-party service (such as ordering a ride through Uber), AXIOM acts as your agent, transmitting your request and the minimum necessary information (such as your location and destination) to that service. AXIOM does not store your payment information for these services. Your use of these third-party services is subject to their own terms of service and privacy policies. AXIOM is not responsible for the actions, availability, or policies of third-party services.

Your AXIOM data lives in a per-user database — completely separate from every other user's data. OAuth tokens for connected services are encrypted at rest. Databases are backed up daily.

(c) Cross-border data transfer

AXIOM is operated from Calgary, Alberta, Canada. Some of our subprocessors (Railway, Anthropic) host infrastructure in the United States. By using AXIOM, you consent to the transfer of your data to the United States for processing and storage. We require our subprocessors to maintain appropriate data protection standards.

(d) Data breach notification

In the event of a data breach that poses a real risk of significant harm to you, we will notify affected users by SMS or email within 72 hours of confirming the breach, and we will report the breach to the Office of the Privacy Commissioner of Canada as required by PIPEDA.
